1. Agreement to Terms

By accessing and using Creative Kids Collective services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our website located at creativekidscollective.com.au (the "Service") operated by Creative Kids Collective ("us", "we", or "our"). Our Privacy Policy also governs your use of the Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

2. Use License

Permission is granted to temporarily download one copy of the materials on Creative Kids Collective's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the materials
use the materials for any commercial purpose or for any public display
attempt to reverse engineer any software contained on the website
remove any copyright or other proprietary notations from the materials

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Creative Kids Collective at any time.

3. Event Services

Creative Kids Collective provides children's event planning and entertainment services. By booking our services, you agree to the following terms:

Booking and Payment: A deposit is required to secure your event date. Full payment is due 48 hours before the event.
Cancellation Policy: Events cancelled more than 14 days in advance will receive a full refund minus a 10% processing fee. Events cancelled within 14 days are subject to a 50% cancellation fee.
Weather Policy: For outdoor events, we will work with you to reschedule in case of severe weather conditions.
Age Requirements: Our services are designed for children aged 3-12 years. Adult supervision is required at all events.

4. Safety and Liability

The safety of children is our top priority. All our staff are certified and background-checked. However, parents and guardians remain responsible for their children's behavior and safety during events.

Creative Kids Collective maintains comprehensive insurance coverage. In no event shall Creative Kids Collective or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Creative Kids Collective's website, even if Creative Kids Collective or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Photography and Media

By attending our events, you consent to photography and video recording for marketing and promotional purposes. If you do not wish your child to be photographed, please inform our staff at the beginning of the event.

We respect privacy and will never share personal information about attendees. Photos and videos are used solely for business promotion and may appear on our website, social media, and marketing materials.

6. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization.

7. Prohibited Uses

You may not use our Service:

For any unlawful purpose or to solicit others to perform unlawful acts
To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
To infringe upon or violate our intellectual property rights or the intellectual property rights of others

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

10. Governing Law

These Terms shall be interpreted and governed by the laws of Victoria, Australia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
